Depending on the nature of the relationship, Point Solar may collect and process:

• Names, surnames and identity or company-registration information
• Telephone numbers, email addresses and other contact details
• Physical, installation, billing and service addresses
• Property, electricity-consumption and energy-usage information
• Municipal account details and information required for SSEG applications
• Photographs, plans, drawings, diagrams and technical information relating to a site
• Quotations, contracts, invoices, payment records and transaction information
• Communications, enquiries, complaints and service records
• Website usage, device, browser, cookie and technical information
• Supplier, contractor, employee and employment-related information
• Any other information voluntarily provided to Point Solar

Point Solar will not intentionally collect personal information that is unnecessary for a legitimate business or legal purpose.

  1. HOW WE COLLECT PERSONAL INFORMATION

• During consultations, site assessments, quotations, installations and maintenance visits
• From clients, representatives, property owners, suppliers or contractors
• From municipalities, Eskom, network service providers and regulatory authorities

Where reasonably practicable, Point Solar will collect personal information directly from the person concerned.

Point Solar may process personal information to:

• Conduct consultations and site assessments
• Prepare designs, proposals and quotations
• Supply, install, commission, monitor, maintain and repair systems
• Process SSEG, municipal, Eskom or network-service-provider applications
• Communicate about projects, appointments, services and support
• Manage contracts, warranties, suppliers and contractors
• Issue invoices, receive payments and maintain accounting records
• Verify identity, authority, ownership or regulatory information
• Meet tax, labour, safety, regulatory and legal obligations

• Investigate complaints, faults, disputes or suspected misconduct
• Improve services, website functionality and customer experience
• Send direct marketing where consent or another lawful basis exists

Personal information will not be used for an incompatible purpose unless authorised by the data subject or permitted by law.

Point Solar processes personal information where:

• Processing is necessary to conclude or perform a contract
• Processing is required to comply with a legal obligation
• Processing protects a legitimate interest of the data subject
• Processing is necessary for Point Solar’s legitimate business interests
• Processing is otherwise permitted under POPIA or applicable law

Where processing depends on consent, consent may be withdrawn. Withdrawal will not affect processing that was lawful before the withdrawal.

Point Solar may share relevant personal information with:

• Installers, electricians, engineers and approved contractors
• Equipment manufacturers, distributors and warranty providers
• Accountants, auditors, legal advisers and professional consultants
• Website, software, communication, cloud-storage and IT providers
• Banks, payment-service providers and debt-collection service providers
• Municipalities, Eskom and electricity network service providers
• Regulatory, governmental, law-enforcement or judicial authorities
• Other parties where the data subject has consented or the law permits disclosure

Only information reasonably required for the relevant purpose will be shared.

Service providers that process personal information on behalf of Point Solar are expected to maintain appropriate confidentiality and security safeguards.

Point Solar does not sell personal information.

  1. CROSS-BORDER PROCESSING

Some technology, cloud-storage, website or communication service providers may process information outside South Africa.

Where personal information is transferred across borders, Point Solar will take reasonable steps to ensure that the transfer complies with POPIA and that appropriate safeguards are in place.

  1. INFORMATION SECURITY

Point Solar implements reasonable technical and organisational measures to protect personal information against loss, damage, unauthorised destruction, unlawful access, misuse or disclosure.

These measures may include access controls, passwords, device protection, backups, secure storage, confidentiality requirements and restricted access based on business need.

No electronic system is completely secure. Point Solar will review and improve security measures where reasonably necessary.

  1. SECURITY COMPROMISES

If Point Solar has reasonable grounds to believe that personal information has been accessed or acquired by an unauthorised person, it will investigate the incident and take reasonable steps to contain and address it.

Where required by POPIA, Point Solar will notify the Information Regulator and affected data subjects as soon as reasonably possible, subject to any lawful delay or instruction.

  1. RETENTION AND DESTRUCTION

Personal information will be retained only for as long as reasonably necessary for the purpose for which it was collected or as required by law, contract, warranty, tax, accounting, regulatory or legitimate business requirements.

When personal information is no longer required, Point Solar will take reasonable steps to delete, destroy or de-identify it securely.

  1. ACCURACY OF INFORMATION

Point Solar takes reasonable steps to keep personal information complete, accurate and current.

Data subjects should inform Point Solar when their personal information changes or when they become aware that information held by Point Solar is inaccurate.

  1. DATA-SUBJECT RIGHTS

Subject to POPIA and other applicable law, a data subject may:

• Ask whether Point Solar holds personal information about them
• Request access to their personal information
• Request correction or deletion of inaccurate, irrelevant, excessive, outdated or unlawfully obtained information
• Object to certain processing of their personal information
• Withdraw consent where processing is based on consent
• Object to direct marketing
• Request information about parties that have had access to their personal information
• Submit a complaint to Point Solar or the Information Regulator

Point Solar may require reasonable proof of identity before processing a request.

A request may be refused or limited where permitted or required by law. Point Solar will explain the applicable reason where appropriate.

Point Solar may send service information or marketing communications where permitted by law.

Recipients may opt out at any time by using an unsubscribe option or contacting Point Solar at info@point-solar.co.za.

Point Solar will take reasonable steps to honour an objection to direct marketing.

The Point Solar website may use cookies and similar technologies to support functionality, security, analytics and user experience.
